This ________ day of ______________________, 20____, an Agreement is hereby entered into by and between All Dogs’ Heaven, (hereinafter referred to as ADH),

(hereinafter referred to as ADOPTER) as follows:

WHEREAS ADH presently possesses the animal described herein; and whereas ADOPTER wants to obtain possession and custody of said dog. NOW THEREFORE, in consideration of the mutual promises contained herein and for possible other good and valuable consideration, the parties intending to be legally bound, do agree as follows:
1. ADOPTER PROMISES:
a.) To keep this animal as a HOUSE PET and COMPANION and to keep pet strictly indoors unless under secured control and supervision on leash of capable person, or in securely fenced yard UNDER SUPERVISION of capable person. ____________
b.) To provide proper food, shelter, water, and humane treatment for this dog at all times.___________________
c.) To not allow the animal to be used for research, or to abandon it. In the event ADOPTER no longer desires to keep or is unable to keep said animal, ADOPTER agrees to immediately surrender the animal to ADH at ADOPTER’S expense. ADOPTER may NOT release ownership of this animal to ANY other person or agency.___________________
d.) To immediately notify ADH in the event the dog is lost, stolen, or dead, or if ADOPTER’S address or phone number changes. Should the dog become lost, to make every effort to recover it, including visiting surrounding area animal shelters, local police stations, local veterinary offices, and to advertise in at least ONE newspaper of general circulation for at least three (3) days. Furthermore, if the dog has been impounded, to reclaim it and to pay any redemption fee.________________________
e.) To immediately procure veterinary care, if the dog is sick or injured, and obtain all necessary inoculations annually, or to immediately return the animal to ADH.____________
f.) To walk the dog on a leash and not allow it to run free. ADOPTER also agrees not to use this dog for hunting purposes._____________
g.) To keep a collar and identification tag on the animal at all times. ______________
h.) NOT to transport this dog in any open vehicle._________
2. There will be no refund of donations, fees, or any other expenses incurred by ADOPTER if dog is returned to ADH.____________
3. ADOPTER understands that ADH makes NO representation, warranty, or guarantee as to the health or disposition of any dog because ADH is uncertain of it’s background. ADH inquires of known owners whether the dog bites, otherwise ADH makes NO representation, guarantee, or warranty that the dog does not bite.ADH makes NO warranty with respect to the temperament of this dog and will not be held responsible for any damages should the dog act in an aggressive manner. ADOPTER understands that any vaccines administered by ADH are listed on attached form, including dates. ADOPTER also understands that the dog has displayed no evidence of illness or health problems during it’s stay at ADH, except as disclosed in the “comments” section of attached.____________________
4. NO WARRANTY OR GUARANTEE: I understand that every effort is made to offer for adoption, only healthy, even-tempered animals. No guarantees, nor implied / expressed warranties with regard to this animal are made. I understand and agree that it is my responsibility to carefully choose the animal I am adopting and that no guarantees are made regarding the health, temperament, or training of animals for adoption. The animal is adopted “AS IS”. I understand and agree that ADH shall not be liable, in whole or in part, for any personal injury or property damage caused by this animal, or for any injury or illness of this animal, once possession is assumed by the Adopter. The Adopter, hereby, agrees to assume all liability for the animal’s care and any injury or damage done by the animal. Initial: _______
ADH does not perform fecal tests on cats or dogs and only a general de-wormer is given. I understand that it is recommended that I have a veterinarian perform a follow-up fecal exam, to see if the animal needs additional de-worming. Initial: ________
5. ADOPTER agrees to pay the fee of _________________ as reimbursement for vaccines and medical treatment, and services that have been rendered by ADH. This fee is NON-REFUNDABLE, as previously stated above. _____________________
6. ADOPTER hereby certifies that the information included in this contract and given to ADH in the adoption application is truthful and accurate. ______________________
If ADOPTER breaches any of the terms and conditions of this contract, ADOPTER agrees to forfeit ownership and agrees that ADH may repossess this dog. ADOPTER has read all of the statements included in both pages of this contract, and agrees to be legally bound to the terms and conditions stated. ADOPTER has received an exact copy of this signed agreement.
